TrashTastic Terms of Service

1. Introduction

Welcome to TrashTastic! These Terms of Service ("Terms") govern your access to and use of TrashTastic's residential waste collection services ("Services"). By subscribing to or using our Services, you agree to be bound by these Terms.

2. Acceptance of Terms

By accessing our website or subscribing to our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

3. Description of Services

TrashTastic provides the following Services to residential customers:

• Weekly Trash Pickup: Collection of household trash once every week.
• Weekly Recycling Pickup (Optional): For an additional fee, collection of recyclable materials once every week.
• Valet Service (Optional): For an additional fee, we will retrieve your trash bin from a designated location on your property, empty it into our truck, and return the bin to its original location.

4. User Obligations

• Compliance with Laws: You agree to comply with all applicable local, state, and federal laws and regulations regarding waste disposal.
• Proper Waste Disposal: Only appropriate household waste and recyclable materials should be placed in the trash and recycling bins. Hazardous materials, medical waste, and other prohibited items are strictly forbidden.
• Bin Placement: Unless enrolled in the Valet Service, you are responsible for placing your bins at the designated pickup location by the scheduled time and retrieving them after service.

5. Payment and Billing

• Monthly Subscriptions: Billed monthly in advance. There is no fixed term; you may cancel at any time.
• Annual Subscriptions: Pay annually and save the equivalent of one month's service cost.
• Prebilling: All subscriptions are billed before the month or year of service commences.
• Payment Methods: Payments are processed via Stripe. Accepted payment methods are specified at checkout.
• Late Payments: Failure to make timely payments may result in suspension or termination of Services.

6. Cancellation and Refund Policy

• Monthly Subscriptions: You may cancel at any time. No refunds will be issued for partial months.
• Annual Subscriptions: If you cancel before the renewal date, we will recalculate your charges based on the standard monthly rate for the period used and refund the difference.
• Cancellation Process: To cancel, please log into your account on our website or contact customer service.
• Refunds: Eligible refunds will be processed within 7 business days to the original payment method.

7. Valet Service Terms

• Enrollment: Valet Service is optional and can be added to your subscription for an additional fee.
• Approval: TrashTastic reserves the right to not approve or cancel Valet service for any reason.
• Accessibility: You must ensure that our personnel have safe and unobstructed access to your bins.
• Service Limitations: If access is impeded, we reserve the right to skip the pickup without refund for that instance.
• Liability: TrashTastic is not responsible for damage to bins resulting from normal wear and tear during service.

8. Service Modifications and Interruptions

• Schedule Changes: TrashTastic reserves the right to modify pickup schedules due to holidays, weather conditions, or other unforeseen circumstances. Notice will be provided via email or posted on our website.
• Service Interruptions: In the event of service interruptions, we will make reasonable efforts to resume service as soon as possible.

9. Limitation of Liability

• No Warranties: Services are provided "as is" without any warranties, express or implied.
• Limitation: TrashTastic shall not be liable for any indirect, incidental, or consequential damages arising out of or related to the use of our Services.
• Maximum Liability: Our total liability to you shall not exceed the amounts paid by you for the Services during the [Insert Number] months preceding the claim.

10. Indemnification
